Reporting of Birth Abroad
The law relating to the acquisition of U.S. citizenship abroad by virtue of birth can be complex, but in general the following two basic rules apply:
- A child born abroad to two U.S. citizen parents acquires U.S.
citizenship at birth, or
- A child born abroad to one U.S. citizen parent and one non-citizen
parent can acquire U.S. citizenship at birth if the U.S. citizen parent
can demonstrate that he/she was physically present in the United States
for a minimum of five years, at least two of which were after the age
fourteen, prior to the birth of the child.
To register the birth of your child, please e-mail the consular section at ConsularMuscat@state.gov to set up an appointment.
We require that the parents bring the child to the Consular Section with the following documents:
- Child's official original Omani birth certificate in English (plus
two photocopies);
- Parents' original passport (plus two photocopies);
- Parents' original marriage certificate (translated into English
whenever applicable) plus one photocopy;
- Original certificate of termination of any prior marriage(s) (ie.
divorce or death certificate) plus one photocopy;
- In cases in which only one parent is a U.S. citizen, that parent
should complete an affidavit and provide evidence that he/she has been
physically present in the United States for the requisite period (see
above) before the child's birth; and meets the requirements for
transmission of citizenship. This requirement does not apply when both parents
are U.S. citizens;
- Typed application for Consular Report of Birth Abroad and Social
Security Number (Form DS-2029/SS-5), available at the Embassy;
- A fee of $65.00 or R.O. 26.000, payable in cash.
The official record of the child's birth is in the form of a Consular
Report Of Birth Abroad of A Citizen of the United States of America
(FS-240). This document is considered a basic United States citizenship
document. An original FS-240 is furnished to the parents at the time the
registration is approved.
To process a passport for the above child we require:
- A properly completed Application for U.S. Passport (Form DS-11),
typed or filled out in blue or black ink;
- Three photographs;
- Both parents to appear with the child. However, if only one parent
is applying that parent should submit a signed statement from the
non-applying parent consenting to the passport issuance to the child;
- A fee of $85.00 or R.O. 34.000, payable in cash.
